1. About Bedspread

Bedspread ("the Service") is a shared-accommodation management application operated by Gratuit Ltd t/a APTAC Solutions (Company Registration Number 579054), an Irish limited company. Use of the Service is subject to these Terms.

2. Your Account

You access the Service on behalf of the company identified in your user record. You are responsible for keeping your login credentials confidential and for any activity performed under your account. Credentials must not be shared. You confirm you are authorised to act on behalf of your company in uploading and managing data within the Service.

3. Your Data & Responsibilities

Data you submit (including but not limited to occupant names, contact details, passport or identification numbers, contract agreements, and payment records) remains owned by your company. Bedspread acts as a processor of that data and stores it in Google Workspace services (Sheets and Drive) associated with the account you connect.

You confirm you have obtained lawful basis and any necessary consent from all data subjects (including occupants) to process their personal data through the Service, in accordance with the General Data Protection Regulation (GDPR) and the Irish Data Protection Act 2018.

4. Contracts Generated by the Service

The Service provides contract templates as a convenience. Neither Bedspread nor its operators are law firms and we do not provide legal advice. You are solely responsible for ensuring that any agreement you generate using the Service is lawful, enforceable, and appropriate to your circumstances. You acknowledge that Irish residential tenancy law is complex; agreements described as "licences" may in some circumstances be deemed tenancies by a court, with attendant statutory obligations. You are advised to have any agreement reviewed by a qualified solicitor before use.

5. Limitation of Liability

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Bedspread excludes all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Bedspread shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, arising out of your use of the Service.

6. Data Retention & Deletion

Your company data is retained for as long as you remain an active user of the Service. You may request deletion of your data by contacting info@bedspread.io. Deletion will be completed within 30 days, subject to any legitimate retention obligations.

7. Service Availability

Bedspread makes reasonable efforts to keep the Service available but does not guarantee uninterrupted access. Scheduled maintenance, third-party service disruptions (including Google Workspace, Netlify, or domain registrar outages), or other factors may cause temporary unavailability.

8. Changes to These Terms

Bedspread may update these Terms from time to time. Material changes will be communicated by email and by requiring re-acceptance on next login. Continued use after re-acceptance constitutes agreement to the updated Terms.

9. Governing Law

These Terms are governed by the laws of Ireland. The courts of Ireland have exclusive jurisdiction to resolve any dispute arising under or in connection with these Terms.
