LICENSE TO RESIDE + HOUSE SHARE RULES
This is a binding agreement. It’s purpose is to promote household harmony by clarifying the expectations and responsibilities of the property owner (licensor) and the licensees of the property, taking note that the licensees are sharing a home. The licensee agrees to share the common areas (such as kitchen, living room, basement etc.) cooperatively with all current and future licensees of the property.
The licensor may at times occupy a room or bedspace or provide a room or bedspace to any person at any time a room or bedspace is vacant (that is not being provided to any other licensee) for any duration as decided by the licensor.
In the event that a room or bedspace is vacant/not occupied by an existing licensee, the licensor retains sole discretion as to the choosing of future licensees. The licensor retains the right to move any licensee to another room/bedspace in the property upon 12 hours notice (written or electronic).

Parties to the Agreement
(“licensor”) agree to provide a bedspace at the above property (“the property”) as accommodation to ________________________ (“the licensee”) (Passport Number __________). The licensee agrees not to sublet or share the accommodation with any other person.
Length of Agreement
This agreement runs on a week-to-week (Monday to Sunday) basis commencing __________. The licensor has sole discretion to terminate the contract at any time they see fit, upon 12 hours notice (written or electronic). Either party may cancel this agreement upon 12 hours notice (written or electronic). A refund will only be due to the licencee when the agreement is cancelled by the licensor and the licensee has paid the licence fee fully in advance for the week. The licencee agrees to vacate the property within 12 hours of receipt of notice to vacate.
Lodging/License fee, Security Deposit and Bills (cost of utilities)
EUR _____ is payable Weekly, in advance, on or before the Sunday prior to the period accommodation is to be provided. A refundable security deposit of EUR _____ is payable in advance and due with the first fee on . The fee includes any utility/service bills but does not include the cost of repair of damage to the property. Any cost for the repair of damages caused by the licensee will be deducted from the security deposit and the balance returned to the licensee after the property is vacated by the licensee and inspected by the owner or the owner’s representative/agent. If the security deposit is not sufficient for the cost of required repairs, the licensee will be liable for all such costs.
Review of Agreement
A review of this License Agreement will occur at the end of the term of the agreement or prior to the renewal or issuance of a new agreement after 12 hours notice provided by the licensor of their intention to carry out said review. At this time the licence fee and the terms of the agreement will also be reviewed and may be changed at the licensor’s discretion.
Privacy
The licencee agrees to respect the privacy of each other licencee and will not enter any other licensee’s bedspace or bedroom or interfere with any other licensee’s belongings. Failure to respect other licensee’s privacy or property will result in immediate permanent vacation of the property by that licencee. The licensor (or their agent) will only enter the licensee’s room for the following reasons: (a) in case of emergency; (b) to make necessary agreed upon repairs; (c) to show the property to prospective or actual purchasers or future licensees; (d) when the licensee has abandoned the room; or (d) pursuant to court order. The owner will give the licensee notice (written or electronic) of intent to enter. The licensee has no right whatsoever to exclude or prevent the owner from accessing the property or any part of the property at any time.
No bedroom is to be treated as or considered to be a flat/bed-sit or any other type of self-contained unit. Licensee are advised to lock the door of their bedroom as a simple security measure and to prevent unwelcome/unwarranted access to their “private” space/belongings.
Visitor Policy
The licensee may have visitors to the house and is asked to notify all other occupants where possible via text or whatsapp message. No visitors are permitted to stay overnight. Any visitors must abide by the rules of the house outlined in this agreement.
Cleaning Policy
The licensee is solely responsible for the upkeep and tidiness of their own bedroom or bedspace. All licensees in the house are jointly responsible for ensuring all shared areas are kept to a reasonable standard of cleanliness and hygiene. After using a shared area, each licensee should leave the area clean and tidy. Each licensee will be responsible for ensuring the same standards from any visitors that may be staying as per the visitor policy outlined above. If the licensor finds that any part of the property is not being maintained to an appropriate standard, the licensor may have the property professionally cleaned the cost of such cleaning being added to the fees for that period to be paid by the licensees.
Conflict Resolution
Each licensee will strive to develop mutual co-operation with all other licensees. Should disagreements arise, each shall try to resolve the dispute in good faith using clear communication. If disputes continue thereafter the licensees agree to the final decision by the licensor, which may include the expiration of the agreement and requirement for licensees to permanently vacate the property.
Rights and Obligations of the Licensee and Owner.
The provision of accommodation provided under this agreement does not amount to a tenancy arrangement. From www.lawonline.ie: “Licence arrangement or tenancy arrangement? A form of agreement described as a licence is often used by parties who wish to avoid the effects of statutory restrictions or the requirements of the Residential Tenancies Act 2004. For example, a person classified as a Licence will have a right of renewal, a right to be provided with sufficient notice of termination of tenancy etc. It is important to note, however, that the courts have on some occasions interpreted arrangements described as a ‘licence agreement’ as in fact a tenancy agreement. The following are the main elements that may differentiate a licence from another type of interests in a property: A licensee or lodger does not usually have exclusive possession. If they have exclusive possession of the property that may be proof of the existence of a tenancy. A licence or lodging arrangement only gives a person personal rights. There is no interest assigned to the licensee or lodger and so they have no statutory protection at law. A licensee or lodger cannot claim adverse possession of the property given they are occupying the property with the owner’s consent. A simple licence (i.e. where no payment is made for the lodging) is revocable at any time, whereas a contractual licence or lodging agreement is subject to the terms of the contract. A licence or lodging agreement may have to be examined to see whether the relationship between the parties is in fact a licence, lodging relationship or an agreement that has given rise to a tenancy agreement. This is required when a dispute arises and the parties need to determine their legal rights and entitlements. In the case of a dispute between a licensee and owner or licensor, a number of issues will have to be examined, for example, the term the parties to describe themselves; the payment terms including payment dates; the relationship between the parties; the degree of control exercised by the owner or licensor; the repair and other obligations on the parties; the right of the owner or licensor to enter and retake possession of the property etc. In the case of a licence arrangement, it is usual for the owner to allow the licensee to take and use a room in a house in return for a weekly or monthly payment and the owner usually reserves the right to terminate the relationship at short notice. Licensee’s rights Broadly, a licencee does not have a right to challenge the level of fee that he or she has agreed to pay. Nor does the licencee have exclusive use of the entire premises. The fact that the owner retains control over the premises and the licencee’s lack of possession independent of the owner is what distinguishes a licensee from a tenant.”
